gigaAI Service and Fair Usage Policy (FUP)

1. gigaFlex+ Plan Access

Subscribers on the gigaFlex+ Plan are entitled to utilise the gigaAI generative platform feature embedded within the App. Access to gigaAI is not billed separately, and subject always to our operational Fair Usage Policy (FUP).

2. System Stability and Daily Reset

To preserve system stability, if a subscriber’s daily interaction frequency or data volume exceeds our standard consumer thresholds (as determined in our sole discretion), the system will automatically cease generating output and suspend further processing for the remainder of that calendar day. Access and the standard thresholds will reset at midnight (00:00 hours) daily.

3. Monthly Quotas

The following gigaAI functions are subject to the following fixed monthly quotas that do not roll over:

3.1. Image Generation: Strictly capped at 300 images per calendar month.

3.2. Deep Research: Strictly capped at 10 research sessions per calendar month.

3.3. Web search: Unlimited, subject to the general network capabilities and FUP parameters as solely determined by us.

4. Service Provided As-Is

All text, images, or analyses generated by gigaAI are provided on an “as is” and “as available” basis. In line with standard generative AI vulnerabilities, giga! makes no warranties regarding the accuracy, completeness, copyright compliance, or reliability of any AI outputs.

5. Intellectual Property Rights and Output Indemnity

5.1. You acknowledge that any text, images, code, or other deliverables generated by gigaAI (“Output”) are compiled via automated machine learning algorithms. giga! makes no claim of ownership over the Output generated by you.

5.2. To the maximum extent permitted under the Copyright Act 2021, giga! does not warrant or represent that the Output is free from third-party intellectual property claims. AI models may inadvertently replicate or resemble pre-existing copyrighted works. You use and disseminate the Output entirely at your own risk.

5.3. You shall fully indemnify and hold harmless giga! and its Affiliates against any and all third-party actions, claims, or demands alleging infringement of copyright, trademark, or patent laws arising from your commercial or public use of any Output.

6. Input Restrictions and Data Privacy (PDPA Disclaimer)

6.1. You are strictly prohibited from entering, uploading, or prompting gigaAI with any text or media that contains sensitive personal data, proprietary business information, or trade secrets belonging to any third party.

6.2. In compliance with the Personal Data Protection Act 2012 (PDPA), giga! shall not be held liable for any data breaches, leaks, or unauthorized exposure of personal data resulting from your voluntary inclusion of such information within gigaAI prompts.

6.3. You understand and agree that prompts and inputs may be utilized for machine learning optimization and system monitoring, subject to our Privacy Policy.

7. Prohibited Content and Online Safety Compliance

7.1. You must not use gigaAI to create, generate, or propagate content that is defamatory, obscene, malicious, or racially/religiously inflammatory.

7.2. You explicitly agree not to use the service to generate deepfakes, coordinated misinformation, or any material that violates the Protection from Online Falsehoods and Manipulation Act 2019 (POFMA) or the Online Safety (Miscellaneous Amendments) Act 2022.

7.3. If giga! detects or reasonably suspects that you have used gigaAI to generate prohibited content, we reserve the right to immediately and without notice:

• (a) Delete or block access to the offending prompt or Output;
• (b) Terminate or suspend your gigaAI access; and
• (c) Cooperate with statutory law enforcement agencies and provide user metadata logs where legally mandated.

8. Absolute Exclusion of Professional Advice and Reliance

8.1. gigaAI is intended strictly for general informational, creative, and entertainment purposes. You acknowledge that AI systems are prone to “hallucinations” (the generation of false, logically flawed, or factually incorrect assertions).

8.2. Output does not constitute, and must not be relied upon as, professional medical, legal, financial, architectural, or engineering advice.

8.3. Under no circumstances shall giga! or the Relevant Parties be liable for any direct or indirect economic loss, physical injury, or operational damage resulting from your reliance on gigaAI-generated output.

9. Pass-Through Vendor Terms and Service Availability

9.1. The gigaAI service relies on large language models (LLMs) and application programming interfaces (APIs) licensed from external software providers. Your access to gigaAI is conditionally bound by any applicable end-user pass-through restrictions imposed by these third-party operators.

9.2. Notwithstanding any other clause in this Agreement, giga! does not guarantee uninterrupted availability or zero-latency performance of gigaAI. Any upstream outage, API modifications, or discontinuation of services by our third-party AI suppliers shall constitute a Matter Beyond Our Control under Clause 11.6 of the giga! Mobile Terms & Conditions, for which we bear no financial liability.
